Statutory caps set by MaklerG §15 + Immobilienmakler-Verordnung §10.

Sale — three tiers:

  • Price ≤ €36,336.42: max 4 % + 20 % VAT
  • Price €36,336.43 – €48,448.51: flat €1,453.46 + 20 % VAT
  • Price ≥ €48,448.52: max 3 % + 20 % VAT

Rent:

  • Indefinite / over 3 years: max 2 gross months + USt
  • Fixed up to 3 years: max 1 gross month + USt
Gross monthly rent = Net rent + operating costs (Betriebskosten) + 10 % VAT. The full warm rent, not the cold rent.

Since 2023, the Bestellerprinzip applies for rentals — the broker can only bill the renter if the renter explicitly engaged them.
